1. Introduction and Acceptance

Welcome to SerpProxies. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”, “you”, “your”) and SerpProxies (“SerpProxies”, “we”, “us”, “our”).

By creating an account, making a purchase, or using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

2. Service Description

SerpProxies provides proxy services including but not limited to residential proxies, datacenter proxies, ISP proxies, IPv6 proxies, and mobile proxies (“Services”). Our Services are digital services delivered electronically and activated immediately upon purchase.

3. Eligibility and Account Requirements

3.1 Age Requirement

You must be at least 18 years of age to use our Services. By using SerpProxies, you represent and warrant that you meet this requirement.

3.2 Business Use Declaration

Our Services are designed and intended for business and professional use. By purchasing our Services, you represent and warrant that you are acting in your professional or business capacity, or that you fully understand and accept the terms applicable to digital services as outlined in these Terms.

3.3 Account Responsibility

You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring that all information provided is accurate and current
• Notifying us immediately of any unauthorized use of your account

3.4 Identity Verification (KYC) and Anti-Fraud Screening

SerpProxies performs identity verification (KYC) and anti-fraud screening to keep the platform safe. These checks are carried out with our verification partner, ComplyCube, which processes verification data on our behalf. Full details are set out in our KYC & Anti-Fraud Policy, which forms part of these Terms.

When KYC may be required:

SerpProxies reserves the right to request identity verification from any user at any time. KYC may be required in the following circumstances:

• New account registration (if flagged by our security systems)
• High-value transactions or unusual purchase patterns
• Suspicious account activity
• Chargeback or payment dispute filed against your account
• At SerpProxies’s sole discretion to maintain platform security

Required documents:

When identity verification is requested, you must provide:

• Your full legal name
• Your current residential address
• Clear photographs of a valid government-issued photo ID (front and back). Accepted documents: passport, national identity card, or driver’s license.
• A short selfie video of yourself holding the ID document next to your face

Compliance timeline:

You must complete the KYC process within 7 business days of the request. Failure to comply within this period may result in:

• Temporary suspension of all active services
• Withholding of refunds or account balance payouts
• Permanent account termination

Fraudulent submissions:

Submitting fraudulent, altered, stolen, or otherwise invalid identity documents will result in immediate and permanent account termination without refund. SerpProxies reserves the right to report fraudulent submissions to relevant law enforcement authorities.

Data handling:

Your KYC documents are processed through our verification partner, ComplyCube, in accordance with our Privacy Policy. Please review our Privacy Policy for full details on how your identity documents are collected, stored, retained, and protected.

4. Purchases and Payment

4.1 Payment Processing

All purchases require valid payment information. By making a purchase, you:

• Represent that you have the legal right to use any payment method provided
• Authorize us to charge all fees incurred to your payment method
• Agree that all payment information provided is accurate and complete

4.2 Pricing

All prices are displayed in the applicable currency at checkout. We reserve the right to modify pricing at any time. Price changes will not affect orders already confirmed.

4.3 Third-Party Payment Processors

Payments are processed through third-party payment providers. Your use of these services is subject to their respective terms and privacy policies.

5. Immediate Performance and Right of Withdrawal

5.1 Nature of Digital Services

SerpProxies Services are digital services that are activated and delivered immediately upon successful payment. The Services begin performing instantly to provide you with immediate access to our proxy infrastructure.

5.2 Express Request for Immediate Performance

By completing your purchase, you expressly:

• Request and consent to the immediate performance and activation of the Services during the 14-day cancellation period;
• Acknowledge and agree that the Services will begin immediately upon successful payment;
• Acknowledge that once the Services have been fully performed — for example, once a purchased balance or allowance has been fully consumed — your statutory right of withdrawal is lost.

5.3 Effect on the Right of Withdrawal (UK and EU/EEA Consumers)

If you purchase as a consumer in the UK, EU, or EEA, you retain a 14-day right of cancellation, which operates as follows:

• If you cancel within 14 days before the Services are fully performed, you pay a proportionate amount for the service actually supplied up to the point of cancellation, and we refund the remainder;
• The right of withdrawal ends once the Services have been fully performed, where performance began at your express request and with your acknowledgment that the right would be lost on full performance;
• For any one-off supply of digital content not on a tangible medium, the right of withdrawal is lost once the supply begins, with your express consent and acknowledgment.

Full details of how to cancel and how refunds are calculated are set out in our Refund Policy. Our voluntary Satisfaction Guarantee is broader than this statutory right and remains available in addition to it.

5.4 Legal Basis

This section reflects Regulations 36 and 37 of the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and Articles 9, 14 and 16 of the EU Consumer Rights Directive 2011/83/EU (as amended by Directive (EU) 2019/2161), which govern cancellation of service contracts performed during the cancellation period and of digital content supplied with the consumer’s express consent and acknowledgment.

6. Refund Policy

6.1 Satisfaction Guarantee

We guarantee a refund if you are not happy with the product you purchased. Approved refunds are issued, at your choice, either directly to the payment method used for the purchase or to your platform balance for future use on SerpProxies.

6.2 Faulty or Non-Conforming Services

If the Services are materially non-functional or fail to operate as described due to issues solely attributable to SerpProxies, please report the issue to support promptly after you discover it — prompt reporting helps us diagnose and fix problems quickly. We will:

• Remedy the technical issue; or
• Provide service credit for future use, if you prefer; or
• Provide a partial or full refund proportional to the non-functional period.

When reviewing a report under this section:

• The issue should be documented and verifiable
• The issue must not result from your misuse, misconfiguration, or violation of these Terms
• The issue must not result from third-party services, your internet connection, or factors outside our control

This section supplements — and never limits — your statutory remedies for services or digital content that do not conform to the contract, including under the UK Consumer Rights Act 2015, Directive (EU) 2019/770, the Australian Consumer Law, and the New Zealand Consumer Guarantees Act 1993.

6.3 Exclusions

Subject always to the Satisfaction Guarantee and to your statutory rights (which are never limited by this section), no refunds, credits, or compensation will be provided for:

• Service interruptions caused by scheduled maintenance (with reasonable notice provided)
• Issues arising from your violation of these Terms or Acceptable Use Policy
• Suspension or termination of your account due to your breach of these Terms
• Third-party service failures or issues beyond our reasonable control
• Partial use of subscription allowances or credits
• Price reductions or promotions occurring after your purchase

6.4 Subscriptions

Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You may cancel future renewals at any time through your account dashboard; cancellation takes effect at the end of the current billing period.

If you are not happy with a subscription product, the Satisfaction Guarantee in Section 6.1 applies — contact support and we will arrange a refund to your original payment method or your platform balance, as you prefer.

6.5 Refund Request Procedure

All refund requests must be submitted via our support channel and must include:

• Your account email address
• Order/transaction reference number
• A short description of what you were unhappy with
• Your preferred refund destination: the original payment method or your platform balance

We will respond to refund requests within 5 business days. Refund requests may be subject to identity verification (KYC) and anti-fraud screening through our verification partner, ComplyCube, before approval.

7. Payment Disputes and Chargebacks

7.1 Chargeback and Dispute Policy

If you initiate a chargeback, payment dispute, or reversal through your bank, card issuer, or payment provider for any transaction with SerpProxies, the following consequences will apply immediately and automatically:

• All active services and plans on your account will be suspended;
• Your account balance will be held and may not be available for use;
• Your ability to make new purchases will be restricted;
• Associated accounts may also be subject to restrictions.

These measures are applied as security precautions to protect against payment fraud and will remain in effect until the dispute is fully resolved to our satisfaction.

7.2 Dispute Resolution Before Chargeback

Please contact SerpProxies support before initiating any chargeback or payment dispute. We are committed to resolving legitimate concerns quickly and fairly — and under our Refund Policy you will usually obtain a faster and better outcome from us directly.

Nothing in this Section 7 limits or excludes any statutory right you may have to dispute a payment, including under the US Fair Credit Billing Act, Section 75 of the UK Consumer Credit Act 1974, or the chargeback provisions of the Quebec Consumer Protection Act. The security measures in Section 7.1 are precautionary, are applied pending resolution of the dispute, and are lifted where a dispute is resolved in your favor or withdrawn.

7.3 Costs and Liability

You acknowledge that chargebacks and payment disputes impose significant costs on SerpProxies, including processing fees, investigation costs, and administrative expenses. You agree to indemnify SerpProxies for all costs associated with a chargeback that is determined to be unjustified or fraudulent.

7.4 Account Restoration

If a chargeback or dispute is resolved in SerpProxies’s favor, or if you withdraw the dispute, contact support to request reactivation of your account. Where a dispute is resolved in your favor, any precautionary restrictions under Section 7.1 will be lifted.

8. Subscriptions and Automatic Renewal

8.1 Billing Cycle

Subscriptions are billed in advance on a recurring basis according to the billing cycle selected at purchase (monthly, quarterly, annually, etc.).

8.2 Automatic Renewal

Subscriptions renew automatically at the end of each billing period. By subscribing, you authorize us to charge your payment method for the renewal fee at the then-current rate.

8.3 Cancellation

You may cancel your subscription at any time via your account settings — cancelling is as simple as subscribing. Cancellation will take effect at the end of the current billing period, and you will retain access to the Services until then. Any refund for the current period is governed by Section 6, our Refund Policy, and your statutory rights.

8.4 Price Changes

We may change subscription fees upon reasonable notice. Continued use of the Services after a price change constitutes acceptance of the new pricing. If you do not agree to a price change, you must cancel your subscription before the next billing cycle.

9. Acceptable Use Policy

9.1 Prohibited Activities

You agree not to use our Services for any unlawful purpose or in violation of any applicable laws or regulations. Prohibited activities include, but are not limited to:

• Any illegal activities under applicable law
• Unauthorized access to computer systems or networks
• Distribution of malware, viruses, or harmful code
• Spam, phishing, or fraudulent activities
• Harassment, abuse, or threats toward any person
• Infringement of intellectual property rights
• Activities that exploit, harm, or attempt to harm minors
• Circumvention of security measures or access controls
• Interference with the proper functioning of any system or network
• Any activity that violates the terms of service of target websites or services
• Resale of Services without authorization
• Sharing account credentials with unauthorized parties

9.2 Compliance

You are solely responsible for ensuring your use of the Services complies with all applicable laws and regulations in your jurisdiction.

9.3 Consequences of Violation

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund, and we reserve the right to report illegal activities to appropriate authorities.

10. Service Availability and Modifications

10.1 Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. Services are provided on an “as available” basis.

10.2 Maintenance

We may perform scheduled or emergency maintenance that temporarily affects service availability. We will provide reasonable notice of scheduled maintenance when possible.

10.3 Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of Services.

11. Intellectual Property

11.1 Our Property

All content, features, functionality, trademarks, and intellectual property associated with SerpProxies are owned by SerpProxies or its licensors and are protected by applicable intellectual property laws.

11.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose.

11.3 Restrictions

You may not copy, modify, distribute, sell, lease, or create derivative works based on our Services or any content therein without our express written permission.

12. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

• The Services will meet your specific requirements
• The Services will be uninterrupted, timely, secure, or error-free
• The results obtained from use of the Services will be accurate or reliable
• Any errors in the Services will be corrected

13. Limitation of Liability

13.1 Exclusion of Damages

To the maximum extent permitted by applicable law, SerpProxies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business
• Loss of data or data breach
• Business interruption
• Loss of goodwill or reputation

13.2 Cap on Liability

Our total liability for any claims arising from or related to these Terms or the Services shall not exceed the amount paid by you to SerpProxies in the three (3) months preceding the claim.

13.3 Essential Purpose

These limitations apply regardless of the form of action, whether in contract, tort, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.

14. Indemnification

You agree to indemnify, defend, and hold harmless SerpProxies, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights
• Any content or data you transmit through the Services

15. Account Termination

15.1 Termination by You

You may close your account at any time by contacting support. Any refund in connection with account closure is handled in accordance with Section 6 and our Refund Policy.

15.2 Termination by SerpProxies

We may suspend or terminate your account immediately, without prior notice or liability, if:

• You breach any provision of these Terms
• You engage in prohibited activities
• We are required to do so by law
• We discontinue the Services
• We detect activity associated with payment fraud, chargeback abuse, or use of multiple accounts to circumvent restrictions
• For any other reason at our sole discretion

15.3 Effect of Termination

Upon termination:

• Your right to access the Services ceases immediately
• Refunds, where applicable, are handled in accordance with Section 6 and our Refund Policy; no refunds are provided where termination results from your breach of these Terms
• Provisions that by their nature should survive termination shall survive

16. Communications

By using our Services, you consent to receive electronic communications from us, including service announcements, administrative messages, and promotional materials. You may opt out of promotional communications via the unsubscribe link provided or by contacting support.

17. Third-Party Links and Services

Our Services may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. Your use of third-party services is at your own risk.

18. Governing Law and Jurisdiction

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

18.2 Jurisdiction

Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of England and Wales.

18.3 Consumer Rights

Nothing in these Terms affects any mandatory consumer protection rights that cannot be waived or limited by contract under applicable law.

19. Dispute Resolution

19.1 Informal Resolution

Before initiating any formal proceedings, you agree to first contact our support team to attempt to resolve any dispute informally. We will endeavor to resolve complaints within 30 days.

19.2 Alternative Dispute Resolution

For UK consumers, alternative dispute resolution (ADR) services may be available under the Alternative Dispute Resolution for Consumer Disputes Regulations 2015. We are not obligated to participate in ADR proceedings before any specific consumer arbitration body.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

21. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

22. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and SerpProxies regarding the Services and supersede all prior agreements and understandings.

23. Amendments

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

24. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

25. Force Majeure

SerpProxies shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

27. Acknowledgment

By using our Services or making a purchase, you acknowledge that:

• You have read and understood these Terms of Service

• You acknowledge the effect of immediate performance on your right of withdrawal as described in Section 5
• You understand that refunds are governed by Section 6 and our Refund Policy, including our Satisfaction Guarantee
• You understand that initiating a chargeback or payment dispute may result in immediate suspension of your account and services as described in Section 7
